Travel Arbitrations
We currently work with a number of travel trade associations providing their members with an agreed form of dispute resolution service.

Our panel have wide experience of dealing with travel, holiday and leisure related issues and their legal implications and have practical experience of travelling and understand the difficulties and disappointments that can arise.
The appropriate Arbitrator will decide disputes by reference to all the documentary evidence supplied by the parties.

Where it is felt necessary and appropriate to do so, the parties may be contacted to clarify points in their evidence, but this is only at the discretion of the Arbitrator. Both parties must agree to be bound by the decision which is final. It is incumbent on the parties to submit any evidence and documentation upon which it relies. It is not to be expected that the Arbitrator will make any requests for clarification or ask to see further evidence.

The maximum sum which the Arbitrator may award under this arrangement is limited to £5,000.00 per individual, but subject to a maximum sum of £10,000.00 for any one booking. This service is not considered suitable for claims which are solely or mainly in respect of physical injury or illness or the consequences thereof.

TIMESCALE FOR SETTLEMENTS
  1. Upon receipt of an application from a customer, Dispute Settlement Service Ltd will inform the tour operator of the Arbitration. Dispute Settlement Service Ltd asks that the tour operator submit a response to that claim within 28 days of being so advised (subject to rule number 8). The Administrator may use his/her discretion with regards to enforcing time limits.
  2. The Arbitrator will then consider all evidence and publish a decision usually within 4 to 6 weeks, copies of which will be forwarded to both parties.
  3. The tour operator must then make payment of any compensation awarded within 14 days of the Arbitrator's decision being published.
The timescale for payment of compensation is 14 days from receipt of the Award decision notice.

Fees are £120 for the Claimant and £175 for the Respondent.

Our panel have wide experience of dealing with travel, holiday and leisure related issues and their legal implications and have practical experience of travelling and understand the difficulties and disappointments that can arise.
The appropriate arbitrator or mediator will decide disputes by reference to documentary evidence supplied by the parties.

Where it is felt necessary and appropriate to do so, the parties may be contacted to clarify points in their evidence, but this is only at the discretion of the Mediator/Arbitrator. Both parties must agree to be bound by the decision which is final.
